Ability to maintain a high level of confidentiality, prioritize work assignments, possess the ability to communicate clearly and concisely in both verbal and written form and work with the Township’s software programs. Position Title: HUMAN RESOURCES SPECIALIST/HIPAA PRIVACY OFFICIAL

Supervisor : Township Manager

Hours of Work : A minimum of 40 hours per week is expected, but more may be required. Overtime will be paid if additional work hours are required by workload demands with approval by the supervisor.

Place of Work : The Human Resources Specialist is based at the Township Municipal Building, 209 S. Sporting Hill Road.

General Description: The purpose of this position is to assist the Township Manager in the accomplishment of administrative and personnel management, administration of all Township-provided benefits and insurances and ensuring compliance with all applicable labor laws.

The position requires an elevated level of confidentiality and independent judgment.

To oversee compliance by the Township and the Township Health Plans with HIPAA’s privacy rules and applicable State health plan privacy laws and regulations.

This Job Description Relates to the Privacy Official of the following health plans of the Township:

  • Capital Blue Cross PPO 250
  • Davis Vision
  • Delta Dental

Essential Functions: Administer and be responsible for all Township insurance plans, claims and concerns; including Township-provided benefits, Workers' Compensation and General Liability to include enrollment, claim submission(s) and administration and policy/coverage recommendations.

Conduct new employee orientation and other employment related best practices training sessions. Process all new hire enrollments including: Form I-9, payroll taxes, benefit enrollment, physicals, background investigations and Department of Transportation notices.

Maintain all personnel related files.

Process and administer all FMLA requests.

Prepare annual Affordable Care Act 1095-C forms and prepares payment requisition for the Patient-Centered Outcomes Research fees.

Ensure compliance with and keeps up-to-date on all labor law, ACA, FMLA/ADA, HIPAA, DOT and other employer related requirements.

With input from the Township Manager and Department Heads, prepare and maintain all full-time job descriptions.

Conduct Exit Interviews and benefit enrollment terminations.

Advise the Township Manager and Department Heads on HR policies and employment related matters, as requested and needed. When required, works with the Township’s third-party labor counsel on matters.

Oversee the implementation of the Township’s DOT and Non-DOT Drug and Alcohol Testing Program and conduct annual employee driving record checks.

Serve as the Township's and Township Health Plans' designated contact person to receive questions, comments, and complaints related to (1) any Township Health Plan participant's protected health information (PHI); (2) any HIPAA privacy practices and procedures of the Township Health Plans; and (3) alleged violations of HIPAA or any applicable state health plan privacy law or regulation.

Perform initial and periodic risk assessments related to HIPAA and applicable state law health plan privacy compliance by the Township Health Plans.

Ensure the Township's and the Township Health Plans' compliance with: - HIPAA (as amended by the HITECH Act) and any applicable state law health plan privacy laws applicable to Township Health Plans; and all privacy practices and procedures of Township Health Plans.

Oversee the development, implementation, and maintenance of appropriate privacy policies and procedures for the Township Health Plans.

Oversee the development, implementation, and maintenance of appropriate documents and forms for the Township Health Plans, including: - privacy policies; privacy use and disclosure procedures; authorization forms; business associate contracts; and other required forms and documentation.

Oversee the development, implementation, and maintenance of appropriate systems and processes for privacy of PHI of the

Township Health Plans, including systems and processes to monitor, track and index: - the timely delivery of business associate contracts and notices of privacy practices; signed and returned business associate contracts; signed and returned authorization forms; requests by participants in the Township Health Plans to restrict access to their PHI, to have access to their PHI, to amend their PHI, and to respond to any required accounting of uses and disclosures of their PHI; appropriate administrative, technical, and physical security measures to protect PHI; compliance with HIPAA and applicable state law health plan privacy laws and regulations; and the retention of all required documentation for at least six years.

Work with legal counsel to ensure that policies, procedures, forms, and other documents of Township Health Plans comply with HIPAA (as amended by the HITECH Act) and applicable state health plan privacy laws and regulations and that appropriate amendments have been made to these documents.

Work with business associates and insurance companies of the Township Health Plans on privacy issues.

In cooperation with the Security Official for the Township Health Plans, arrange for and oversee the timely training of appropriate members of Township's workforce regarding HIPAA and other applicable state health plan privacy laws and regulations, as well as the Township Health Plans' privacy policies and procedures.

Investigate privacy complaints against Township Health Plans and resolve them when possible.

Work with the Security Official for the Township Health Plans to ensure appropriate coordination between the privacy and security programs for the Township Health Plans, including compliance with the requirements of the HITECH Act to provide notification to affected individuals, HHS, and the media (when required) if the Township Health Plans or one of the business associates discover a breach of unsecured PHI.

Work with senior management to oversee the implementation of appropriate sanctions for violation of privacy polices and practices of the Township Health Plans or for violation of HIPAA or any applicable state health plan privacy laws and regulations relating to Township Health Plans.

Cooperate with the Office for Civil Rights (OCR), or other appropriate entity, in any compliance review, audit, or investigation.

Undertake any other activities relating to the Township Health Plans that are necessary or desirable to comply with HIPAA and applicable state health plan privacy rules and regulations or directed by Supervisor.

Supervise and train Township Receptionist and alternates.

Assist and advise Township Manager in all areas of administration and support function management.

Assist and advise in Township budget preparation relating to all insurance programs.

Qualifications:

  • A minimum of a BA/BS degree, preferably in Human Resources Management, with a minimum of three years related experience.
