As a Legal Collections Specialist at Apex Commercial Capital you will be working within the Collections group managing the legal and collection aspects of outstanding debts related to equipment financing and commercial mortgage loans. This role involves working closely with legal teams, clients, and debtors to ensure compliance with relevant laws and regulations while pursuing debt recovery through legal channels. Your familiarity with litigation, negotiation, and understanding of equipment financing and commercial mortgage intricacies will be essential in achieving successful resolutions.

JOB DUTIES AND RESPONSIBILITIES:

  • Legal Knowledge: Utilize an understanding of legal procedures and regulations to manage the litigation process for equipment finance and commercial mortgage collections. Interpret laws, regulations, and contracts to make informed decisions and guide the collections process.
  • Negotiation: Engage in negotiations with debtors, their legal representatives, and other relevant parties to explore settlement options and achieve mutually agreeable outcomes that align with the company's goals.
  • Compliance: Ensure strict adherence to all relevant laws and regulations governing debt collection practices, including but not limited to the Fair Debt Collection Practices Act (FDCPA) and any state-specific regulations. Ensure compliance with Apex Commercial Capital policies and procedures.
  • Documentation: Maintain comprehensive and accurate records of all interactions, communications, and actions taken throughout the litigation and collections process. This includes updating internal systems and databases.
  • Communication: Effectively communicate with internal teams, clients, and external legal partners to provide updates on case progress, potential risks, and recommended courses of action.
  • Risk Assessment: Assess potential risks and benefits associated with various legal actions, settlement offers, and collection strategies. Provide recommendations based on these assessments.
  • Continuous Improvement: Stay updated on changes in relevant laws, regulations, and industry best practices. Continuously improve processes and strategies to enhance the efficiency and effectiveness of the collections and litigation efforts

  • Prolonged periods sitting at a desk and working on a computer.

EDUCATION, TRAINING AND EXPERIENCE:
  • Bachelor’s degree in business, finance, or a related field or equivalent experience.
  • Paralegal certification a plus.
  • 5+ years of experience in foreclosure and mortgage litigation, preferably with a focus on debt collection.
  • Strong understanding of commercial loan agreements and associated legal complexities.
  • Excellent negotiation, communication, and interpersonal skills.
  • Detail-oriented with the ability to manage multiple cases simultaneously.
  • Proficiency in legal research, documentation, and case management software.
  • Sound judgment and decision-making abilities.
  • Knowledge of relevant federal and state laws and regulations related to debt collection.
